1 Acceptance of Terms

By downloading, installing, or using Tic Tac Toe — Themes ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

These Terms constitute a legally binding agreement between you and SDCode ("we", "us", "our"). If you are under 13 years of age, please have a parent or guardian review these Terms before using the App.

2 License to Use

SDCode grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your Android device for personal, non-commercial purposes, subject to these Terms.

This license does not include:

  • Sublicensing, selling, or reselling the App or any portion of it
  • Modifying or creating derivative works based on the App
  • Using the App for any commercial purpose or for any public display
  • Reverse engineering, decompiling, or disassembling the App

3 Use Restrictions

You agree not to use the App in any way that:

  • Violates any applicable local, national, or international law or regulation
  • Is fraudulent, deceptive, or harmful to SDCode or other users
  • Attempts to gain unauthorized access to any part of the App or its infrastructure
  • Interferes with or disrupts the integrity or performance of the App
  • Attempts to manipulate game statistics or circumvent theme unlock mechanics by unauthorized means
  • Attempts to circumvent, disable, or interfere with AdMob advertising systems

4 Advertising

This App is free to use and is supported by advertising provided by Google AdMob. By using the App, you acknowledge and agree that:

  • Advertisements will be displayed within the App
  • You will not use any means to block, remove, or circumvent the display of advertisements
  • Google AdMob may collect data in accordance with Google's Privacy Policy and its own terms
  • Where required by law (e.g. GDPR), you will be given a choice regarding personalized advertising

The content of advertisements is provided by Google and third-party advertisers. SDCode is not responsible for the content of those advertisements.

5 Intellectual Property

All content in this App — including but not limited to graphics, themes, game artwork, sounds, code, and design — is the exclusive property of SDCode or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the App without our express written permission.

6 Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the App will be uninterrupted, error-free, or free of viruses or other harmful components
  • That the results obtained from using the App will be accurate or reliable

SDCode does not warrant that the App will meet your requirements or that any defects will be corrected.

7 Limitation of Liability

To the fullest extent permitted by applicable law, SDCode shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Damages resulting from unauthorized access to or alteration of your data
  • Any other matter relating to the App

Our total liability to you for any claim arising from these Terms or your use of the App is limited to the amount you paid for the App (which is zero, as the App is free).

8 Termination

These Terms remain in effect as long as you use the App. SDCode reserves the right to terminate your access to the App at any time, for any reason, without notice.

You may terminate these Terms at any time by uninstalling the App from your device. Upon termination, the license granted to you will immediately cease.

9 Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the developer, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the appropriate courts in the developer's jurisdiction.

10 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. We may also notify you within the App for significant changes.

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and uninstall it.
